The Estate and Trust Counsel will handle, supervise and manage all Legal and Estate and Trust Administration functions plus general non-profit law matters.
This position is located at the Association’s Home Office in downtown Chicago and reports to the Vice President-Legal & General Counsel.
Areas of Responsibility:
- Handle, manage and oversee all legal aspects of estate/trust administration gifts and files.
- Review trusts, wills, correspondence, pleadings, trust statements and accountings for all trusts and estates and recommend follow up actions.
- Prepare accurate, timely summaries of estate administration matters to be used by finance for financial statements. Recommend and prepare pledge documentation.
- Identify estates and trusts with potential litigation issues, work with outside counsel when necessary, set litigation budgets, manage litigation and review legal invoices for compliance with outside counsel guidelines.
- Develop a system to expedite trusts/estates. Work with attorneys, CPAs, executors, trustees and other professionals to facilitate and expedite probate and trust administration proceedings and gift distribution.
- Build and maintain amicable relationships and communicate with colleagues and chapters.
- Supervise specialist/paralegal support.
- Develop processes and follow-up procedures to facilitate requests for documents and information from attorneys, trustees, and estate personal representatives.
- Summarize probate and trust administration proceedings for senior staff and advise senior staff regarding avenues to pursue and potential outcomes.
- Assist General Counsel with contract review, general corporate projects and drafting for general Association matters, as needed.
- Keep current on laws that impact the estate administration process.
- Other projects and duties as assigned.
Educational Background:
Juris Doctorate and active Illinois bar admission
Skills/Experience:
- 6-9 years of progressive experience in estate administration and probate court or other litigation
- Non-profit organization experience and familiarity with nonprofit laws
- Experience with computer based donor or client tracking software, donor database software a plus
- Knowledge of estate and income tax codes, probate and trust administration law
- Excellent verbal and written communication skills
- Communicate effectively with attorneys, tax professionals, and department staff
- Ability to perform research and use Westlaw
- Ability to read, write and perform mathematical calculations
- Ability to memorize, creatively problem solve, manage multiple priorities and meet deadlines
- Anticipated travel: 0 - 10%
